Lash Boss Academy Early Bird Purchase Terms & Conditions:
Welcome to the Lash Boss Academy 4-week course (herein as “Course”) Terms and Conditions of purchase (herein as “Conditions”) created by Lauren Saunders (herein as “Lauren” or “we” or “us” or “our”). You are expected to read and understand these Conditions in its entirety before proceeding with your purchase.
By using our website to purchase this Course, you agree and acknowledge that you have read this Conditions in its entirety and agree to abide and be bound by them. If you do not agree with any of the provisions in this Conditions, please refrain from purchasing until you have cleared up any confusion by contacting Lauren Saunders (course creator and facilitator) via email at lauren@laurencsaunders.com.
Lauren in her sole discretion has the right to modify or revise a part of this Conditions from time-to-time.
REGISTRATION
To be eligible for purchasing and participating in the Course, you must register through our website at
www.laurencsaunders.com/lashbossacademy. After payment is completed you will be emailed your receipt as well as the link to the program Facebook group and course material.
You must be at least 18 years of age to participate in the Course. We do not knowingly permit individuals below 18 years of age to submit payment details to purchase the form.
PURCHASE TERMS
You acknowledge that making payments for the Course requires us to collect your billing information and other personal information. Your billing information will never be used for any purpose other than for the payment of the Course and will not be shared with third parties. By supplying us your billing information, you warrant to us that you hold the right and capacity to use any billing information supplied to us and that any information you submit is accurate and complete. You further acknowledge that Lauren will not be liable for any funds lost or problem you may encounter due to your submission of the wrong information.
PAYMENT TERMS
You acknowledge that you cannot have access to the Course Content unless you make a payment.
Payment can be made with your credit card which will be charged automatically for subsequent payments (for instalment plans in section 4.3 below).
Payment is of 2 types;
A one-time early bird payment of $697 ($100 off the full course price of $797 if purchase of the Course is made before 10:00PM EST on the date that the early bird period expires); or
A 3-time bi-weekly payment plan of $247 charged automatically from your credit/debit card after the initial instalment payment; or
You acknowledge and agree that you cannot cancel the payment once you have access to the Course Content.
NO REFUNDS
Due to the manner in which the Course is made available to you, you will NOT be entitled to a refund once your payment has been made and you have access to the Course Content. Notwithstanding this statement, in a situation where there is an accounting error in relation to your payment under this Conditions, we shall rectify such error through the proper payment adjustments.
CANCELATION AND TERMINATION
You acknowledge that we have the right to refuse or cancel your purchase of the Course due to reasons such as unavailability of service or an error in the price or your purchase. You further agree that we will not be responsible for any loss or damage arising out of such refusal or cancelation.
We also have the exclusive right to cancel or terminate your participation without refunds if we detect or suspect a fraudulent, illegal or unauthorized act has been carried out on your payment or there is a default in one of the instalments.
INSTALMENT OPTIONS
If you are participating in the Course via the instalment plan, you agree that your credit/debit card or any payment option you choose will be charged in the time stated for any plan you choose. You also agree that your payment option must contain funds sufficient enough for the instalment charge as and when due.
TECHNOLOGY REQUIREMENTS
You are responsible for ensuring your participation in the Course with the proper hardware and software tools including a good service connection, Facebook account and computer to consume the course content from.
INTELLECTUAL PROPERTY
The Course materials, articles, skills, teachings, and other contents of the Course (collectively “Course Content”) is the exclusive property of Lauren Saunders and is subject to intellectual property right, copyright, trademark, and other laws in Toronto, Canada and other trade conventions in other locations. We give you the exclusive right as a member to use this Course Content for purposes for which it is intended. You shall not share the Course Content with any third party and you may not copy, use, distribute, or otherwise use in relation with any other product without getting a prior written consent from Lauren. Engaging in the foregoing will be deemed by us as a breach of this Conditions which then gives us the exclusive right to cancel your participation without refunds.
FORCE MAJEUR
Under no event shall Lauren be liable to you for any failure or delay to carry out our obligations in making the Course available resulting from or caused by forces that are beyond our control including but not limited to storms, riots, severe weather conditions, military or civil disturbances, war, internet breakdowns, computer software or hardware service breakdown, embargoes or other acts that are reasonably beyond our control.
GOVERNING LAW
This Conditions shall be governed and construed by the state laws of Toronto, Canada without reference to its conflict of law principles. Any remedies hereunder shall be determined according to this provincial law.
DISCLAIMER
BY PURCHASING THE COURSE, YOU NOW AGREE THAT YOUR PURCHASE AND PARTICIPATION IS AT YOUR SOLE RISK. WE MAKE THE COURSE AVAILABLE ON “AS IS” BASIS AND HEREBY DISCLAIM ALL REPRESENTATIONS AND WARRANTIES WHETHER EXPRESSED OR IMPLIED INCLUDING BUT NOT LIMITED TO THE WARRANTY THAT THE COURSE WILL BE AVAILABLE AT ALL TIME, FIT FOR A PURPOSE, MERCHANTABLE, AND NON-INFRINGING. WE DO NOT WARRANT TO YOU THAT THIS WILL BE A GET-RICH-QUICK SCHEME, THAT YOU WILL MAKE A VERY LARGE SUM OF MONEY FROM THE COURSE OR THAT YOU WILL RECEIVE A CERTIFICATION AFTER YOUR PARTICIPATION IN THE COURSE. You acknowledge that your successful participation and acquiring of desired business results in the course is 100% your responsibility.
LIMITATION OF LIABILITY
NEITHER LAUREN NOR ANY OF OUR SPONSORS SHALL BE LIABLE FOR ANY DAMAGE WHETHER PUNITIVE, CONSEQUENTIAL, DIRECT, INDIRECT, EXEMPLARY OR SPECIAL DAMAGE WHICH MAY INCLUDE BUT NOT LIMITED TO LOSS OF PROFIT, LOSS OF REVENUE OR LOSS OF DATA WHICH MAY ARISE AS A RESULT OF YOUR PURCHASE AND PARTICIPATION IN THE COURSE EVEN THOUGH LAUREN MAY HAVE LEARNED OF SUCH DAMAGE OCCURRING. NOTWITHSTANDING THIS LIMITATION OF LIABILITY STATEMENT, OUR LIABILITY TO YOU, IF WE ARE FOUND LIABLE, SHALL NOT BE MORE THAN THE AMOUNT YOU HAVE USED TO PURCHASE THE COURSE.
INDEMNIFICATION
You now agree to indemnify and hold us harmless from all claims, proceedings, actions, demands, losses, and expenses (including reasonable attorney’s fee) which may arise from you or any third party as a result of your purchase and participation in the Course.
SEVERABILITY
If a provision or a section of this Conditions is found by a competent court having jurisdiction to be unenforceable, illegal, invalid or void, we shall sever or terminate such section while the other valid, legal, and enforceable sections or provisions will remain in full force and effect.
